Complex estate disputes revolve around sentimental value items

Many items passed on to the next generation have sentimental value to beneficiaries. There may be a strong connection to childhood or youth, and these items can bring back nostalgic memories of the time their parents were raising them. This emotional attachment can make disputes more likely.

For example, three siblings may inherit a vacation property together. The property may be worth $1 million, and two of the siblings may want to sell it and split the proceeds, viewing it as a significant part of their inheritance. 

However, the third sibling may have strong memories tied to the vacation home from childhood and want to keep it in the family. That sibling may oppose selling the property and believe they should move forward as joint owners. This difference in perspective can lead to serious conflict over how to handle the real estate.

Some items may not be valuable

Another potential issue is that items can have sentimental value without having much financial value. Disputes sometimes arise over home furnishings, book collections, photographs or other family heirlooms.

These situations can be especially difficult to resolve. When beneficiaries disagree over high-value assets, one solution is often to sell the asset and divide the proceeds. With items that have little or no financial value, however, selling is not helpful because the parties involved are not interested in the money. They are focused on the emotional importance of the item itself.

There are steps parents can take to reduce these issues, such as distributing items with sentimental value during their lifetime rather than including them in a will. When conflicts do arise, beneficiaries need to understand what legal options are available and what steps they can take to address the dispute.
